The Trump administration has filed a petition with the Supreme Court requesting the lifting of a lower court order that directed the US government to bring back a Maryland man who was mistakenly sent to a harsh prison in El Salvador.

A federal judge had given the administration until Monday night to return Kilmar Abrego Garcia to the US. Abrego Garcia, who was deported due to administrative and clerical errors, was previously restricted from being deported to El Salvador due to the risk of persecution from gangs. The White House claims he is a member of MS-13, a claim denied by his relatives.

The administration argues that the court’s deadline complicates international negotiations and infringes on foreign relations. It also states that the US cannot compel El Salvador to follow the court’s orders.

Legal Battles and Deportation

Abrego Garcia’s wife and child are American citizens, and he was deported alongside other migrants accused of gang ties. President Trump used the Alien Enemies Act to facilitate the deportations, a move that has faced legal challenges.

Despite the administration’s efforts to reverse the court order, a three-judge panel rejected the request. The judge who initially ordered Abrego Garcia’s return found no evidence linking him to terrorist activities and criticized the administration’s arguments.

Abrego Garcia’s lawyers maintain he has no criminal record and has faced threats from gangs. The court battle continues as the administration grapples with complying with the court order.

Supreme Court Review

The petition will be reviewed by Chief Justice John Roberts, who oversees appeals from the 4th Circuit. The administration’s next steps in addressing the court order remain unclear.
