DC funeral home gave parents ashes that wasn't their stillborn son: lawsuit

A grieving couple is taking legal action against a Washington, DC funeral parlor for allegedly giving them incorrect ashes that did not belong to their stillborn son. They also claim that the funeral home displayed a “Happy Birthday” balloon ahead of the infant’s memorial service in a callous manner.

Brittani Davis and Micheal Jackson filed a lawsuit alleging that Dunn and Sons Funeral Home not only handed over the wrong remains last summer but also engaged in a series of insensitive actions to cover up the mistake. The couple is still trying to obtain the ashes of their son, Micari, more than six months later.

Davis and Jackson stated, “This has been the most difficult time of our lives. Micari’s death was already so painful for our family, and to then be treated so terribly during our tragedy, it has been a lot to bear.”

The couple had expected their son, “Baby MJ,” to arrive in July, but unfortunately, the pregnancy was no longer viable. Davis gave birth to a stillborn baby, as per legal documents filed in DC Superior Court.

In an attempt to find closure, Davis and Jackson hired Dunn and Sons Funeral Home to handle the arrangements, which allegedly turned out to be chaotic from the beginning.

Despite requesting white and gold balloons for their son’s memorial service, they were provided with an assortment of colorful balloons, including one with the words “Happy Birthday,” which upset Davis as she expressed, “He’ll never have a birthday.”

Subsequently, the funeral parlor gave them a container of ashes without the cremation certificate, leading to further suspicions about the authenticity of the remains they received.

After a confrontation with the funeral parlor owner, Tresa Dunn, Jackson discovered that the ashes given to them belonged to a baby girl with the initials MD, not their son Micari. Dunn allegedly attempted to cover up the mistake by changing the date on the cremation certificate.

The lawsuit is seeking $10 million in damages for each of the grieving parents.
